We will provide private personal service of process by Attorney agent for "Personal hand delivery of documents to a defendant", legal courier by a method accepted by the Hague Convention. No translation of documents, No use of local Notary public or Apostilles are necessary, and we guarantee our service!.
We will instruct local judicial officers, if required by the service type, exactly the same way the Central Authority since the Judicial Officers employed are excatly the same.
We will bypass the Central Authority as intermediary since our service is direct, services are not distributed according to local territorial Jurisdiction ("Red tape") or submitted to approval we serve what you send.
We will complete service immediately as sgreed by multilingual Attorneys at law, qualified and reliable, offering the maximum guarantees of confidentiality, respect for privacy and image, compliance with local laws of procedure and courteous to your opponent.
We will provide you a custom made "Affidavit of Service", according to your case's laws of procedure and needs, including the Hague Convention, European Union's laws and those of the Country where service is completed ("Lex fori and Lex loci"). Our affidavits specify the applied laws and will be submitted to your approval. Affidavits are written in English and authenticated by the department's of State Notary Public or equivalent. We can use your affidavit of preference.
We will guarantee not only, the delivery of documents, but service's efficacy in Court. Thereto, if service is challenged we will support your response to the motion without any extra charge.
We will keep prices, all included and depending on the type of service and contract; If service is upon an individual or a corporation, time to serve and the necessary "due diligence". Cost for service to individuals is more because harder to serve than Corporations. Serving Individuals often requires various attempts and therefore more time for completion. Notice in our Price list three different basic types of Private Personal Service of process by Art. 10. All these services are under the Hague Convention provisions and no hierarchy exist between them. The choice of method depends on your time frame and service budget.
We will accept payment by Credit Cards or Bank transfer in Euros, U.S. or CAD dollars to our European (French and Spanish), American or Canadian bank accounts.
Personal Service A and B; from ASAP in A to 30 days in B; include;
* Notarization of the Affidavit of service issued by the Attorney proces, written in English and authenticated by the Consular representation.
* Legal advise to defendant, refers to advise of a qualified multilingual Attorney at law during service of documents as a guarantee of compliance with local and foreign laws of procedure.
* All services include the Hague's Notice for International services and we propose a "Stand by defendant's anwer" in the event a response to you.
* Redundant Service, service could be reinforced by other methods, as a preventive measure, if required by local law, for example a "Judicial Officer"or if our Attorney considers it to be necessary for reinfocement based on the circumstances of the case and therefore adding guarantees.
* Certified returned receipt mail could complete the notification efforts ending in three simultaneous international services of process!
* Due diligence: When serving a Corporation and extract of mercantile registry is retrieve from public registries in order to serve at the headquarters address and their registered officers, this is done to serve properly and legally. For individuals a "Skip-trace and locate" search is completed also before service.
* Temporary affidavit of service is sent immediately by email and a final legalized is sent overnight or within days, but not before you have approved and corrected our draft Article 10 c, refer to service by Certified Returned receipt mail or Fax, serviced by private or public mail. Note that some North American Jurisdictions do not accept service by mail.
Other Services;
Substitute service: Only Individuals. This service is completed in accordance to the Hague Convention's regulations. The communication and means of service employed vary from country to country in Europe. This service is under our direct supervision, we do not guarantee its efficacy unless combined with Art. 10 services.
Collect Service: If requested by plaintiff and accepted by defendant, after payment of an administrative fee we can be charged the cost of service on delivery (C.O.D.) to defendant.
Service by Publication: As a registered law firm in Europe we provide Service of Process by Publication and/or public posting, service includes an Affidavit of Services a with legal back up.
Divorce Service: fast and reliable service for international divorces which can include return of signed documents by defendant, price is reduced.
